As a long time comcast cable customer and product of a family tradition. It was only natural I seek employment through this company. My mother, grandmother, uncle, husband, brother, cousin, aunt, cousin in law & high school friend all work for Comcast. Not to mention once I was hired I grew close to a lot of my fellow; now former, co-workers.. whom shall all remain nameless or referred to as "Coaxial hamsters." During orientation company management and many other "high-performing" employees spoke about this fast growing company with a sense for familiarity and the great deal of people they are giving jobs to even during this rough economic tide. I mean This was February and as stated by a local Hr coordinator Comcast will be hiring 300 people from now (Feb.) until September. Shortly following with a closing statement of a "high turn-over rate." The company policy was clearly stated this first day and a great deal of packets and videos to watch regarding any possible situation or question that could arise was addressed promptly; day 1. ....8 weeks Training later... I absolutely love this job, easy to understand, no scripts, no over the top company policies, great atmosphere & the people; wonderful! Striving, bringing home decent paychecks every two weeks ranging $700-$900 without commission; I was at an all time high and feeling well accomplished.
Now lets ring in the Meat and potatoes ... In orientation management states familiarity and this "open-door-policy." Well from the moment I was interviewed and even considered for the position I was later hired for I kept an open dialogue with every one necessary regarding my medical condition Guillain Barre Syndrome. I explained what it was provided medical documentation. Verifying that it is a legit condition that does not inhibit myself from performing at work* with the exception of a few minor details. I should receive no repercussion for missing work as long as; i call in at least an hour before my scheduled shift, I have a doctor &/or physical therapist appointment (w/ proof of visit), or last but certainly not least I fall out paralyzed from the waist down & yack up everything in my stomach, like in 2004 when I was diagnosed with this condition.
Yes well with a few incidents happening & providing the company with the "proof" they needed; I was put up on a list they name as "Review for Termination." This does not bode well. No. I research my options and legal rights, due to the ironic fact that this company tells me I have no options and I may be fired due to my attendance. ATTENDANCE THAT HAS BEEN POPULATED POORLY IN COMCASTS SYSTEM BECAUSE OF A MEDICAL CONDITION THAT IS INCURABLE. Well in only hours of research I came upon "ADA" The Americans with Disabilities Act that was passed in 1990 by President George Bush Sr. Basically making it "officially" illegal for any employer to terminate an employee with any permanent medical disability other than an astigmatism or a need for corrective lenses. Now common sense says if your in a wheel chair working for a large corporation and your fired in regards to you being in a wheel chair; yes that is illegal, BUT, if you.. the same person in a wheel chair working for Big Company 3 & you sexually harass another employee and your fired; that's just protocol, you have no legal case. Naturally, we all know this.
Why would a company such as Comcast omit any options as far as job security to a tenured employee who has a disability?WHO if KNOWS. Well I finally got HR to sign ADA papers filled outed by myself and my doctor, stating if I follow specific guidelines & my absences are due to my GBS; I'm exempt from being fired, unless I commit a horrible act of harassment or company fraud, etc.
Guess who got fired a few months later. ;] First a meeting; results, Paid Administrative leave. About a week and 3 days later a phone call from Comcasts local Hr Coordinator stating .."as of now we have to terminate you. we don't feel that we have been provided with enough detail pertaining to your "condition" Guillain Barre, and your attendance is good to a point, then it hits this metaphoric cliff. I'll have your personal items overnight to your home through UPS. Anything you would like to add?"...
There was nothing I could say. And it has been a month and I still haven't received my personal items through UPS or anyone for that matter. I spoke with other employees of Comcast including Region District managers, the son of the CEO & many others who were genuinely appalled by the way I was treated and the outcome of such a "touchy" situation. I was also advised to get a lawyer and file a suit. With help from many sources who shall also stay nameless, I have been told I have an extremely good case that could definitely change the future for Comcast. Not something I am trying to do, I just want my justice. Recently got a call from one of Comcasts very own Attorneys who offered to fight my case at his expense.
Being told I will either receive my job back with double my pay rate or a minimum lump settlement of $1.5 million dollars.
Not something I think Comcast was intending to happen. Hiring specific people in my local Hr office was definitely the OOPS~ in this case.
We'll see what happens; I'll keep you posted. -Who's Jane
